Please see the EMF Media Lab Policy for specific policy regarding the new system and equipment and facility use. Because we have a limited supply of high-demand resources, Electronic Media and Film Production Labs(EMF) cancels bookings that do not adhere to EMF Policy. Our goal is to make our resources available to the largest possible number of borrowers and to prevent unfair booking practices.
*For courses requiring group work, the group as a whole will be considered “the user”. All group members are responsible and liable for equipment, policy and facilities. No group member will be exempt.
By using any EMF Media Lab equipment or facility you, the user, agree to the following terms and conditions. The user also agree to follow Media Lab Policy laid out in the EMF Media Lab Policy and Handbook. The Terms and Conditions can change as deemed necessary.
A. Collection of Equipment - Equipment must be collected from the EMF Production Labs at the agreed upon time during business hours or by an appointment pre-arranged in advance. Collection of equipment occurs when said Equipment is received by Renter. All reservations are automatically deleted from the system after 4 hours of non-collection.
a. Parking near the Media Center is limited. Renters and anyone associated with transporting the renter’s equipment is responsible to park legally. EMF is not responsible to tickets or towing.
b. The renter is responsible in transporting equipment safely from the Media Center to their location. EMF Production Labs has limited carts to help. If no carts are available, then the renter is responsible for moving equipment.
c. Do not remove equipment from loaded carts within the EMF Production Labs without authorization from a Supervisor.
d. Carts cannot be taken off campus, overnight or for longer than loading or unloading takes the renter and crew.
B. Testing of Equipment - Renter is responsible for any damages caused to Equipment, Renter, location, or persons during testing of Equipment, except if and to the extent caused by the negligence or willful misconduct of the EMF Production Labs. Renter shall notify EMF Production Labs of any defective or inoperable Equipment immediately upon discovery and no later than within 3 hours of Equipment being collected as defined in Section I Paragraph A. above. Otherwise, Renter agrees that the Equipment is in good working order and acceptable to Renter and acknowledges that they have inspected and tested the Equipment.
C. Use of Equipment - Renter shall only allow the Equipment to be used by duly qualified and/or licensed technicians in strict accordance with its contemplated use. Renter shall not permit the Equipment to be used in violation of any laws. EMF equipment can only be used for the completion of EMF course work per the requirements of the courses that the Renter is enrolled in, or with an EMF Production Lab Supervisor approved production. Use of EMF equipment for personal or paid production services is strictly prohibited.
D. Risk and Liability - Renter assumes all risk and liability for the Equipment, including, but not limited to, risks while: in transit, on location whether named or unnamed, at all studios, on own premises, in use, and in storage; until the Equipment is returned to the EMF Production Labs, except if and to the extent caused by the negligence or willful misconduct of EMF Production Labs. Equipment is rented without warranty or guarantee of any kind, expressed or implied. EMF Production Labs assumes no responsibilities unless agreed to in writing, provided that EMF Production Labs shall disclose safety issues or defects that EMF Production Labs IS, or should be, In the exercise of reasonable prudence, aware of. EMF Production Labs is not liable for any injury caused by equipment while in the Renter’s possession. Safe usage and general Set Safety is the responsibility of the Renter.
E. Return of Equipment - Equipment must be returned to the EMF Production Labs by appointment pre-arranged in advance. Late returns are subject to the suspension of the renter’s and the group members EMF accounts. The Equipment will not be considered returned until all of the following conditions have been met. an inventory has been completed and a missing and damaged list has been compiled. The acceptance of the return of the Equipment is not a waiver by EMF Production Labs of any claims that it may have against Renter. Renter is also responsible for parking and transport as stated in section A.
*Equipment not returned for 5 days will be deemed as stolen/missing, and the user will be charged for the full replacement of the kit(s). These charges will be applied to the user’s Bursars account. Students who have more than 3 late returns could face longer ban periods to be determined by the EMF Production Lab Supervisor.
F. Lost, Stolen, or Damaged Equipment - Renter must notify EMF Production Labs immediately of any missing, lost, or stolen Equipment and file a report with the local authorities. In the event that, after the Renter takes delivery of Equipment, any of the Equipment is lost, stolen, damaged, or destroyed, Renter will be held responsible for the replacement cost. EMF Production Labs will make a reasonable effort to repair or replace the Equipment in a timely manner. If Equipment is returned damaged or in non-working condition, the lease period will be extended by the shortest reasonable time necessary to repair such damage or replace non-repairable Equipment and return the items) to EMF Production Lab’s general inventory, but only for the actual loss sustained, not to exceed the value of the Equipment. The extended rental period shall apply only to the damaged or nonworking item(s), unless the item(s) form a part of or within a kit of other Equipment. There may be delays in repair or replacement due to causes beyond EMF Production Lab’s control.
G. Replacement Cost of Equipment - Should EMF Production Labs, in conjunction with Renter and Renter's representatives, determine that any Equipment must be replaced, whether due to loss, theft, damage, destruction beyond repair, or disappearance, Renter will be responsible for the replacement cost of same item or closest comparably equipped model, at current retail prices less any discounts available, without deduction for depreciation. Rental payments may not be applied to the purchase price of any Equipment. In determining whether Equipment shall be replaced or repaired, EMF Production Lab’s judgment shall be final.
H. Image, Content, and Data Storage - Renter must clear all images, content, or data from the Equipment prior to returning it. If Renter fails to do so, EMF Production Labs is authorized to do so, without prior notice to Renter. Renter is solely responsible for storing and safeguarding its images, content, and data prior to returning the Equipment.
I. Sublease and Lending – Renter may not sublease or lend all or any part of the equipment. Renter specifically acknowledges Towson University, The Department of Electronic Media and Film, and the State of Maryland’s superior title and ownership of the equipment. Renter may not remove any barcodes, tags, nameplates, stickers, serial numbers or identifying logos on the equipment.
J. Insurance – EMF Production Lab strongly urges Renter to purchase Renter's insurance in the event of loss, damage, and/or theft to Equipment including, but not limited to, Acts of God. Without adequate insurance coverage, Renter acknowledges and agrees to the following:
a. Renter accepts all responsibility for replacement or repair of equipment.
b. Renter cannot use State of Maryland insurance to cover loss, damage or theft while Equipment is in the custody of the renter.
K. Facilities – Computers and studios are available for rental in Media Center 008 to complete coursework which requires renters to utilize Non-Linear Editing software, Digital Audio Workstation, Animation Software, Plug-ins and other software supported by the EMF Department. Renters agree to all EMF policy and agreements. Equipment refers to all EMF equipment both that can leave campus and that is housed in studios or any TU facility.
L. Facility Software – Renters agree to all software EULAs. EMF only supports course approved software. Downloading any software to EMF/TU computers will result in immediate dismissal and loss of ALL EMF Facility access. It is the responsibility of the user to learn software. Staff or not instructors. They can help with basic questions.
M. Facility Check in - Facilities must be collected from the EMF Production Labs at the agreed upon time during business hours or by an appointment pre-arranged in advance. Check ins occur when the renter signs in with EMF Staff located in MC007 or staff office. All reservations are automatically deleted from the system after 15 minutes of non-collection. Renters whose reservation were cancelled due to non-collection will have to wait 2 hours to rebook facilities.
a. All facility renters, group members, talent or renter’s guests must leave a TUID (onecard) or valid state issued ID at the EMF Production Lab Cage in MC007. No other items of collateral will be accepted.
b. If a group booking, the renter whose name the reservation is under must be present at the time of collection.
c. The renter is responsible for transporting any equipment needed in the facility space. Doors cannot be propped open for any period of time. Any personal equipment should be marked as to not be confused with EMF or TU equipment.
d. Renter must check to make sure all equipment and required accessories are present and in proper working condition upon arrival to the space.
e. Issues with the space should be reported immediately. If you are not familiar with the equipment in the space, do not attempt troubleshooting on your own. Inexperience can lead to more issues and longer time to resolve.
N. Facility Use – It is the responsibility of the user to know the operation and usage of all of computers and studios. Any misuse or damage to the studios or any components held within the studios or brought in from outside, will result in loss of access to all facilities and equipment within the EMF department for the user in addition to any fines, replacement costs or repair costs.
a. Absolutely no food or drink in any studio or computer lab.
b. All users must check in at MC007 with EMF staff and leave a TU or valid state ID.
c. Users who do not check in will be asked to leave, and the group will have to reschedule.
d. Improper use of the space will result in loss of access and possible fines for repair or replacement of equipment or facility.
